SMS Disclosure & Consent Notice

We value clear, permission‑based communication. Please read this notice to understand how and why Optimum Ohio Homes LLC (“OOH,” “we,” or “our”) may send you text messages. 

This Disclosure & Consent Statement (“Statement”) governs the transmission of Short Message Service (“SMS”) or Multimedia Messaging Service (“MMS”) communications (collectively, “Text Messages”) by Optimum Ohio Homes LLC (“OOH,” “we,” “us,” or “our”) to any natural person (“you” or “Recipient”) who affirmatively consents to receive such Text Messages. It is intended to comply with the Telephone Consumer Protection Act (47 U.S.C. § 227), applicable Federal Communications Commission (“FCC”) regulations, and current CTIA guidelines.

1. Voluntary Opt‑In

You may provide express written consent to receive Text Messages from OOH by one or more of the following methods:

1. Checking the “Text me about homes” or similar checkbox on an electronic or paper inquiry form and submitting the form;
2. Sending an initiating text containing a keyword (e.g., “INFO,” “YES,” or other published keyword) to an OOH‑controlled telephone number; or
3. Replying affirmatively to a Text Message sent by OOH.

No purchase, rental application, or financing decision is conditioned on this consent.

2. Message Content & Frequency

a. Content. Text Messages may include property availability alerts, scheduling confirmations, transaction updates, payment reminders, or other housing‑related information.
b. Frequency. Message frequency will vary based on your requests but will not exceed four (4) messages per calendar week unless you are actively engaged in a transaction with OOH.

3. Charges

Standard messaging and data rates may apply. OOH assesses no additional fee for Text Messages. All charges are billed and payable to your mobile carrier and remain your sole responsibility.

4. Opt‑Out Procedure

You may revoke consent at any time by replying STOP to any Text Message received from OOH. Upon receipt of a valid opt‑out command, OOH will send one (1) confirmation message and thereafter cease all non‑transactional Text Messages to the opted‑out number unless and until new consent is provided.

6. Carrier Liability

Wireless carriers are not liable for delayed or undelivered messages.

7. Privacy & Data Security

OOH does not sell or rent personal information. Data collected through Text Message programs is used solely to deliver requested services and otherwise as described in the OOH Privacy Policy available at OptimumOhioHomes.com/privacy‑policy or upon written request.

8. Record Retention & Revocation

OOH will maintain records of your consent for a minimum of four (4) years. You may withdraw consent, request a copy of your consent record, or update your contact information by writing to:

9. Severability

If any provision of this Statement is found unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

10. Acceptance

By providing your telephone number and completing any of the opt‑in actions described in Section 1, you acknowledge that you have read, understand, and agree to the terms of this SMS Communication Disclosure & Consent Statement.
